Antenna Restriction Video Reply
by N8TCZ on October 24, 2008 Mail this to a friend!
In perusing the internet I find the web site: www.metacafe.com to have a lot of interesting subjects. From educational to the strange on just about any subject you could imagine.
But, I put in "ham radio" in the search box and came up with a lot of good videos. One that caught my eye was this one: www.metacafe.com/watch/yt-aC_EeWSKJII/antenna_stirs_up_controversy
It is a video of a TV broadcast from WCBD in Lubbock, Texas from April 6, 2006. The ham, I believe his name is Robert Boyd apparently got his ducks in a row to defend his antenna enough to get the neighbors and local government off his case even though they aren't happy about it.

What we truly need is quite simple....

The US Congress to step in and pass a bill that would specificly state that all restrictions and or laws and or ordinances and or state constitutional provisions of HOAs, state and local governments that restrict and or ban external antenna supports of a safe nature be that restriction legal and or contractual in nature shall by be declared NULL AND VOID retroactively. AND THAT the FCC shall be the ONLY agency to govern such structures.

In other words not so nice, Congress and the FCC need to step in and tell state and local law makers that it is the FEDERAL GOVERNMENT that shall govern antenna structures and NOT them.

BUT THIS WILL NEVER HAPPEN as long as political people like to kiss the buttocks of the voters.

DAMN! The people at WCBD, Channel 2 in Charleston, SC are really going to be surprised at this!

I have just a couple of comments about your post. First, if the restrictions about antennas is in the CC&Rs and this antenna violates those restrictions, sooner or later someone is going to figure out that there is no federal law that over-rides CC&Rs for this antenna. There may yet be a lawsuit to get rid of this antenna. Second, did you ever consider the impression that this one Ham is making on the vast majority of the population who are not Hams? Rather than trying to find a solution that is a little less offensive to the neighbors, it appears that this Ham is doing a good job of making sure that each of his neighbors will make sure the next time that antenna restrictions are more severe. Third, looking at the video I too think the antenna is ugly. Forth, trying to push such an extreme positions as removing any and all local control over antennas (zoning, building permits, approved plans, etc.) simply is not going to happen. A far more sensible approach would be to get something in place like making PRB-1 apply to private contracts such as CC&Rs although I wouldn’t hold my breath waiting for that to happen. And finally, your comment “BUT THIS WILL NEVER HAPPEN as long as political people like to kiss the buttocks of the voters” sounds to me like you don’t approve of elected representatives trying to uphold the will of those who elect them. Personally I like the idea of my elected representatives actually considering the wishes of the electorate.

I just watched the video.

The mistake here is that he keeps his tower cranked down, which makes the antenna look very large.

The same 4-element SteppIR beam at 72' looks a hell of a lot smaller and actually will be far less noticed.

Unfortunately he only has a W-51 tower (51' high extended). He should have installed a taller one.

People do not go around looking up at a 45 degree or higher angle -- they just don't. But when you have a big beam spinning just over the roof of the house, sure it's ugly: It's too close.

My beams look ugly when the tower's cranked down. But I hardly ever crank it down. When it's "up" it's far less noticeable; in fact, I've had many non-ham visitors say, "What antenna?" if I ask them about it.

Sounds like the nonsense of Star Trek Diplomacy. Reality is the only way to deal with schmucks like his neighbors is to push right up to the legal edge and hold ground. Then try for another inch.

These NIMBY types which feel your property is their backyard are going to take every inch you surrender. They are nothing more than school yard bully wannabes hiding behind lawyers. This is the same defective intelletuals that will tell you if you don't like what is on tv then turn it off. Well if they don't like what is above the horizon then they should not look up. Or better yet they should plant trees in their yard at their cost to protect their view.

Attitudes such as yours are what leads to increasing restrictions to AR antennas. I only have two comments. First I'm glad you don't live in my neighborhood and second, I feel sorry for your neighbors.

A friend of mine had this problem once....yet the one that was complaining had a huge motor home parked in the driveway right next to a used car business they were running. Last time I thought really hard, selling used cars isn't going to help people in an emergency.
